OBJECT AND SCOPE OF APPLICATION

These Terms and Conditions are intended to regulate the relationship between LINEARGENT, SL (hereinafter LineArgent or the Company), a Spanish commercial entity, with registered office at c/ Costa d'en paratge, 22, 1ª, A , Polígono Industrial Sot dels pradals, 08500 VIC (Spain), and NIF Nº B-59.987.537, registered in the Mercantile Registry of Barcelona, on 29/01/1992, Fol. 142, Volum 24159, sheet nº B- 65.255 and you, relating to all transactions carried out on the website located at lineargent.com.

USE OF OUR WEBSITE

These Terms and Conditions are the only terms applicable to the use of this website and supersede any other terms, unless expressly agreed to in writing by the Company. These Terms and Conditions are important for both you and us, as they are designed to create a legally binding agreement between us, protecting your rights as a customer and our rights as a company. By placing your order, you acknowledge that you have read and agree to these Terms and Conditions without reservation.

You agree that:

a. Only you may use the website to make legally valid inquiries or orders.
b. You may not place any speculative, false, or fraudulent orders. If we have reasonable grounds to believe that such an order has been placed, we are authorized to cancel it and inform the relevant authorities.
c. You also agree to provide us with your correct and accurate email address, postal address and/or other contact details and consent to our use of this information to contact you if necessary (see our "Privacy Statement") .

LineArgent reserves the right to modify these terms and conditions without prior notice. We recommend that you read these terms and conditions each time you place an order with us.

PRODUCT INFORMATION AND AVAILABILITY

Our company strives to keep the products displayed on our website in stock. However, if an order is accepted for an item that is no longer in stock, we reserve the right to cancel it.

The descriptions and images shown on our website are valid for as long as they are published.

Inaccuracies and omissions may occur on some unlikely occasion and LineArgent reserves the right to correct any errors and change or update information at any time without prior notice (including after the order has been processed).

Product images are not contractual and colors may vary depending on the computer screen on which they are viewed and always vary slightly from reality.

HOW IS THE CONTRACT FORMALIZED?

The information and details contained on this website do not constitute an offer to sell, but rather an invitation to do business. No contract will exist between you and us in relation to any product until your order has been expressly accepted by us (even if your account has already been charged). If your offer is not accepted and your account has already been charged, the full amount will be refunded.

To place an order, you must follow the online purchase procedure and click "Authorize Payment." After this, you will receive an email acknowledging receipt of your order ("Order Confirmation"). Please note that this does not mean your order has been accepted, as it constitutes an offer from you to us to purchase one or more products. All orders are subject to our acceptance, and we will confirm this acceptance by sending you an email confirming that the product is being shipped ("Shipping Confirmation"). The contract for the purchase of a product between us (Contract) will only be formed when we send you the "Shipping Confirmation."

Only those products listed in the Shipping Confirmation will be subject to the Contract. We will not be obligated to supply any other products that may have been ordered until we confirm their shipment in a separate Shipping Confirmation.

PRODUCT AVAILABILITY

All product orders are subject to availability. If supply difficulties arise, or if items are out of stock, we reserve the right to inform you about substitute products of equal or superior quality and value that you may order. If you do not wish to order these substitute products, we will refund any amount you may have paid.

REFUSAL TO PROCESS AN ORDER

We reserve the right to withdraw any Product from this website at any time and/or to remove or modify any material or content on it. Although we will make every effort to process all orders, there may be exceptional circumstances that require us to refuse to process an order after we have sent the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion.

We will not be liable to you or any third party for removing any product from this website, regardless of whether that product has been sold or not, removing or altering any materials or content on the website, or for refusing to process an order after we have sent you the Order Confirmation.

Please note that we cannot accept payment methods not specified above. If you attempt to pay using any other method, we will not be liable for the loss of your payment or any other damages caused by your action.

Payment is only accepted in euros.

PAYMENT TERMS AND PRICES

The price of the products will be as stated on our website at any given time, except in cases of obvious error. Although we strive to ensure that all prices displayed on the website are correct, errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, the order will be considered canceled and you will be fully refunded for any amounts paid.

Given the nature of online shopping, the product prices displayed on the website apply solely to purchases made through the website and may not reflect the retail prices at authorized LINEARGENT retailers. Therefore, the prices shown on the website are binding only for online purchases and do not apply to LineArgent stores.

We will not be obliged to supply the product(s) to you at the incorrect lower price (even if we have sent you the Shipping Confirmation) if the pricing error is obvious and unambiguous and could reasonably have been recognized by you as an incorrect price.

Prices on the website do not include VAT, and exclude shipping costs, which will be added to the total amount due.

Prices are listed in euros (EUR), and VAT is not shown until the final recalculation of your order total before payment. LineArgent reserves the right to correct any price and change or update prices at any time without prior notice (including after the order has been processed). Any changes will not affect orders for which we have already sent a "Shipping Confirmation."

All orders for end consumers must be prepaid and can be made by credit card or PayPal. To prevent credit card fraud, you will be required to enter your Card Verification Number (CVV) when paying by credit card. You can find this three-digit number on the back of your card.

Once you have clicked the "Add" button for each item you wish to purchase, they will be added to your bag, and the next step will be to process the order and make the payment. To do so:

1. Click on the "My Bag" button at the top of the page.
2. Click on "View Cart".
3. Click on the "Process Order" button.
4. Fill in or check the information, your order details and the address to which you want the order sent and click on "Proceed to purchase".
5. Accept the "Terms and Conditions".
6. Choose the collection method.
7. Choose the payment method you wish to use for your purchase (credit card or Paypal) and enter the corresponding information.
8. Click on "Confirm Purchase".

VALUE ADDED TAX

In accordance with current regulations, all purchases made through the website will be subject to Value Added Tax (VAT), which will be charged at the rate in force at the time of delivery with the following clarifications and exceptions.

Regarding sales to other member states of the European Union, in accordance with current regulations on distance selling, deliveries will be considered to be located and taxed in Spain when the recipient is a private individual and is established in another member state.

When the recipient is a businessperson or professional, who makes the purchase for the exercise of their economic activity, and provides a VAT number assigned by the tax authorities of another member state, the delivery will be considered to have been made and will be taxed in the country of destination.

For orders destined for the Canary Islands, Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of them.

SHIPPING

Delivery times depend on the destination. Orders shipped within the Iberian Peninsula are generally delivered within one or two business days. Orders shipped to other European Union countries are generally delivered within five to seven business days. LINEARGENT is not responsible for any delays caused by the shipping company.

Orders placed and paid for after 4:00 PM will be processed the following day. Packages will be shipped via authorized carriers.

The shipping cost for your order will depend on the delivery location. Our company charges a flat rate for shipping. Please contact us for more details.

If you receive a package that is visibly damaged or shows signs of having been opened, please do not accept the merchandise. The company will process the immediate return of the package to our company. By signing for the delivery, you are accepting the package in its current condition.

The risks associated with the Products will be your responsibility from the moment of delivery.

You will acquire ownership of the products when we receive full payment of all amounts due in relation to them, including shipping costs, or upon delivery, whichever is later.

DELIVERY AND SHIPPING AND EXCEPTIONAL CASES

Without prejudice to the foregoing and unless extraordinary circumstances arise, we will attempt to ship the order for the product(s) listed in the Shipping Confirmation within 72 hours (on business days). This delivery time may be delayed up to 45 days for any of the following reasons:

Product customization;
Special items;
Unforeseen circumstances;
Delivery area;

If for any reason we are unable to meet the delivery date, we will inform you and give you the option of proceeding with the purchase by setting a new delivery date or cancelling the order for a full refund. Please note that we do not deliver on Saturdays or Sundays.

For the purposes of these Terms, "delivery" or "delivered" shall be deemed to have occurred when the product(s) are signed for at the agreed delivery address.

All shipments to the Canary Islands, Ceuta, Melilla, and other destinations will be sent via courier. If customs holds the package, the recipient will be responsible for all handling fees. This condition is accepted upon purchase. In cases where the item has arrived at its destination and the customer refuses to pay the customs and handling fees, this amount will be deducted from the product refund.

Under no circumstances does LINEARGENT assume responsibility for customs management fees or the taxes derived from them.

IMPOSSIBILITY OF DELIVERY

If we are unable to deliver your order, we will contact you. If we cannot reach you or do not receive a response, your product(s) will be returned to our warehouse. We will send you clear information on the location of your package and how to arrange for redelivery. If you will not be at the delivery address at the agreed time, please contact us to arrange delivery for another day.

Please note that storing and reshipping your product(s) may incur an additional cost.

RETURNS AND EXCHANGES POLICY

Returns or exchanges are permitted within 14 calendar days of receipt. Only unused items in their original condition, properly packaged and sealed, will be accepted. Products may be returned via any shipping company, and all return shipping costs will be your responsibility.

No changes or returns are possible in LINEARGENT stores or corners, even if the online purchase was collected at an authorized point of sale.

WARRANTY

All products come with a two-year warranty (from the date of purchase) covering manufacturing defects. Defective items can be returned free of charge, and LineArgent will decide whether they should be repaired, replaced, or refunded. Repaired items come with a 90-day warranty.

The warranty does not cover items deteriorated or damaged through use or misuse. Returned items must not show any alteration from their original condition. Do not expose any jewelry to chemicals (soaps, acetone, perfumes, bleach, iodine, chlorine, etc.). Exposing jewelry to water, swimming pools, or jacuzzis can also damage it, as can overexposure to heat.

We will carefully examine the returned product and notify you by email within a reasonable timeframe whether or not a refund or replacement will be issued. The refund or replacement will be processed as soon as possible and, in any case, within 60 days of the date we send you an email confirming that the return or replacement of the non-conforming item is approved. A refund will only be issued if we are unable to replace the item with an identical one in perfect condition.

The full amount paid for any products returned due to a defect or fault, where such a defect or fault actually exists, will be refunded, including the delivery charges incurred to deliver the item to you and the costs you incurred in returning it to us. The refund will be issued using the same payment method. If the original payment was made by credit card, the refund will be credited to the same card used for the purchase.

CONTRACT INTEGRITY

These Terms and Conditions and any documents expressly referred to herein constitute the entire agreement between you and us relating to the subject matter of the Contract and supersede any prior covenants, agreements or promises between you and us, whether oral or written.

You and we acknowledge that we have entered into this Agreement without relying on any representation or promise made by the other party or that could be inferred from any statement or writing in the negotiations entered into by the two of us prior to this Agreement, except as expressly stated in these Terms.

Neither you nor we will have any recourse against any inaccurate statement made by the other party, whether oral or written, prior to the date of the Contract, and the other party's sole recourse will be for breach of contract in accordance with these Terms and Conditions.

OUR RIGHT TO MODIFY THESE CONDITIONS

We reserve the right to review and modify these Terms and Conditions at any time. You will be subject to the policies and Terms and Conditions in effect at the time you place each order, unless we are required by law or governmental authority to make changes to these policies, Terms and Conditions, or Privacy Statement, in which case any such changes would also apply to orders you have previously placed.

APPLICABLE LAW AND COMPETENT JURISDICTION

These General Terms and Conditions, as well as any other matter relating to the use and contracting of LineArgent and more, shall be governed by current Spanish legislation. If the user qualifies as a consumer under applicable consumer protection regulations, the courts and tribunals with jurisdiction to resolve any claim shall be those established in said regulations.
