SUBJECT MATTER AND SCOPE

These Terms and Conditions are intended to regulate the relationship between LINEARGENT, S.L. (hereinafter LineArgent or the Company), a commercial entity of Spanish nationality, domiciled at c/ Costa d'en paratge, 22, 1ª, A , Polígono Industrial Sot dels pradals, 08500 VIC (Spain), and N. I. F. No. B-59.987.537, registered in the Commercial Register of Barcelona, dated 29/01/1991, Folio 142, Volum 24159, sheet no. B-65.537, page no. B-65.537.I.F. USE OF OUR WEBSITE

These Terms and Conditions are the only terms and conditions applicable to the use of this website and supersede all other terms and conditions, except with the express prior written consent of the Company. These Terms are important to both you and us as they are designed to create a legally binding agreement between us protecting your rights as a customer and our rights as a company. You declare that, by placing your order, you have read and accepted these Conditions without reservation.

You agree that:

  • a. You may be the only one to use the website for legally valid enquiries or orders.
  • b. You may not place any speculative, false or fraudulent order. If we have reasonable grounds to believe that such an order has been placed we shall be entitled to cancel the order and inform the relevant authorities.
  • c. You are also obliged to provide us with a true and correct e-mail address, postal address and/or other contact details and you agree that we may use this information to contact you if necessary see our "Privacy Statement".

LineArgent reserves the right to modify these conditions without prior notice. We recommend that you read these conditions each time you place an order with us.

 

PRODUCT INFORMATION AND AVAILABILITY

Our company tries to keep the products displayed on our website in stock. In the event that an order has been accepted for an item that is no longer in stock, we reserve the right to refuse the order.

The descriptions and images shown on our website are valid for as long as they are published.

Inaccuracies and omissions may occur on the rare occasion and LineArgent reserves the right to correct any errors and change or update information at any time without notice (including after the order has been processed).

The images of the products are not contractual and the colors may vary depending on the computer screen on which they are displayed and always vary slightly from reality.

 

HOW THE CONTRACT IS FORMALIZED

This information and the details contained in this website do not constitute an offer to sell, but an invitation to do business. No contract will exist between you and us in relation to any product until your order has been expressly accepted by us (even if your account has already been debited). If your offer is not accepted and your account has already been debited, the amount of the debit will be refunded to you in full.

To place an order, you must follow the online purchase procedure and click on "Authorize payment". You will then receive an e-mail acknowledging receipt of your order ("Order Confirmation"). Please note that this does not mean that your order has been accepted, as your order constitutes an offer by you to us to purchase one or more products. All orders are subject to acceptance by us and we will confirm such acceptance by sending you an email confirming that the product is being shipped (the "Shipping Confirmation"). The contract for the purchase of a product between us (Contract) will only be formed when we send you the "Shipping Confirmation".

Only those products listed on the Shipping Confirmation will be subject to the Contract. We shall not be obliged to supply you with any other products that may have been ordered until we confirm the shipment of such products on a separate Shipping Confirmation.

 

PRODUCT AVAILABILITY

All orders for products are subject to availability and, in this regard, if there are difficulties in supply, or if there are no items in stock, we reserve the right to provide you with information about substitute products of equal or superior quality and value that you may order. If you do not wish to order such substitute products, we will refund any amount you may have paid.

 

REFUSAL TO PROCESS AN ORDER

We reserve the right to withdraw any Product from this website at any time and/or to remove or modify any material or content on this website. Although we will do our best to always process all orders, there may be exceptional circumstances that require us to refuse to process any order after we have sent the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion.

We shall not be liable to you or to any third party for removing any product from this website, whether or not such product has been sold, removing or modifying any material or content on the website, or for refusing to process an order once we have sent you an Order Confirmation.

Please note that we cannot accept payment methods not specified above. If you attempt to pay by any other method, we will not be responsible for the loss of your payment or any other damage caused by your action.

Only payment in Euros is accepted.

 

PAYMENT TERMS AND PRICES

The price of the products will be as stated on our website at any given time, except in the case of obvious error. Although we try to ensure that all prices shown on the site are correct, errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and any amount paid will be refunded in full.

Given the particularities of online shopping, the price of the products indicated on the website refers solely and exclusively to purchases made on the website, and does not necessarily coincide with the retail price of authorized LINEARGENT distributors. In accordance with the above, the price indicated on the website is only considered binding for online purchases and in no way binds LineArgent stores.

We shall not be obliged to supply you with the product(s) at the incorrect lower price (even if we have sent you a Shipping Confirmation) if the pricing error is obvious and unmistakable and could reasonably have been recognized by you as the incorrect price.

The prices on the website do not include VAT and exclude shipping costs, which will be added to the total amount due.

Prices are in Euros (EUR) and VAT does not appear until the final recalculation of your order total to proceed to payment. LineArgent reserves the right to correct any prices and change or update prices at any time without prior notice (including after the order has been processed). Possible changes will not affect orders for which we have already sent you a "Shipping Confirmation".

All retail orders must be prepaid and can be placed by credit card or Paypal. In order to prevent bank card fraud, you will be required to enter your Card Verification Number (CVV) when paying by credit card. You can find this three-digit number on the back of your card.

Once you have clicked on the "Add" button for each of the items you wish to purchase, they will have been added to your bag and the next step will be to process the order and make the payment. To do this:

  • Click on the "My Bag" button at the top of the page.
  • 2. Click on "View cart".
  • 3. Click on the "Process Order" button.
  • 4. Fill in or check the information, the details of your order and the address to which you want the order to be sent and click on "Proceed to checkout".
  • 5. Accept the "Terms and Conditions".
  • 6. Choose the collection method.
  • 7. Choose the payment method you wish to use to make the purchase (credit card or Paypal) and enter the corresponding information.
  • 8. Click on "Confirm Purchase".

 

VALUE ADDED TAX

In accordance with current legislation, all purchases made through the Web site will be subject to Value Added Tax (VAT), which will be charged at the rate in force at the time of delivery with the following clarifications and exceptions.

In the case of sales to other member states of the European Union, in accordance with current regulations on distance sales, the supplies will be deemed to be localized and taxed in Spain, when the recipient is a private individual and is established in another member state.

When the recipient is a businessman or professional, who makes the purchase for the exercise of his economic activity, and provides a VAT number assigned by the tax authorities of another member state, the supply will be deemed to have been made and will be taxed in the country of destination.

For orders destined for the Canary Islands, Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of them.

 

SHIPPING

Delivery times depend on where the orders are to be shipped. Orders shipped within the Iberian Peninsula will generally be delivered within one to two working days. Orders shipped to other European Union countries will generally be delivered within five to seven working days. LINEARGENT is not responsible for any delays related to the shipping company.

Orders placed and paid after 16:00 hours will be processed the following day. Packages will be shipped via authorized carriers.

The shipping cost of your order depends on the place of delivery. Our company charges a fixed shipping charge. Please contact us for more details.

In case of receiving a package visibly damaged or with signs of having been opened, we ask you not to accept the goods - the company will arrange the immediate return of the package to our company. In case you sign for the delivery of the package, you accept the package in its delivered condition.

The risks of the Products shall be borne by you from the time of delivery.

You will acquire ownership of the products when we receive full payment of all amounts due in connection therewith, including shipping charges, or at the time of delivery, whichever is later.

 

DELIVERY AND SHIPPING AND EXCEPTIONAL CASES

Notwithstanding the above and unless extraordinary circumstances occur, we will try to ship the order of the product(s) listed in the Shipping Confirmation within 72 hours (in working days). It is possible that this delivery time may be delayed up to 45 days for any of the following reasons:

  • Customization of products;
  • Specialty items;
  • Unforeseen circumstances;
  • Delivery area;

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to go ahead with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Please note that we do not deliver on Saturdays or Sundays.

For the purposes of these Conditions, "delivery" shall be deemed to have occurred or the product(s) to have been "delivered" at the time of signing for receipt of the product(s) at the agreed delivery address.

All shipments to the Canary Islands, Ceuta and Melilla and other destinations will be sent by courier company. In the event that customs retains the package, the recipient will have to pay the handling fees. This condition is accepted with the realization of the purchase. In those cases in which the item has arrived at destination and the customer refuses the customs and handling payment, this amount will be deducted from the return of the product.

In any case LINEARGENT is not responsible for the payment of customs clearance or taxes arising therefrom.

 

FAILURE TO DELIVER

If we are unable to deliver, we will contact you. If we are unable to contact you or do not receive a response from you, your product(s) will be returned to our warehouse. We will send you explicitly where your package is and how to have it sent back to you. If you will not be at the place of delivery at the agreed time, please contact us to arrange delivery on another day.

Please note that storage and reshipment of your product(s) may incur an additional cost.

 

RETURN AND EXCHANGE POLICY

Return or exchange of items is allowed within 14 calendar days from the day of receipt. Only unused items in their original condition and properly packaged and sealed will be accepted. Products may be returned by any carrier and any costs related to the return will be borne by you.

No exchange or refund is possible in LINEARGENT stores or corners even if the online purchase has been picked up at an authorized point of sale.

 

WARRANTY

All products are covered by a two-year warranty (from the date of purchase) covering manufacturing defects. Defective items may be returned free of charge and LineArgent will be responsible for deciding whether they should be repaired, replaced or refunded. Repaired items are covered by a 90-day warranty.

The warranty does not cover items that have deteriorated or been damaged through wear and tear or misuse. Returned items must not show any alteration from their original condition. Do not expose any jewellery to chemicals (soaps, acetone, perfumes, bleach, iodine, chlorine, etc). Exposing jewelry to water, swimming pools or hot tubs can also damage jewelry, as overexposure to heat can also damage the jewels.

We will carefully examine the returned product and will inform you by e-mail within a reasonable period of time whether or not to proceed with the return or replacement of the product. The return or replacement of the item will be made as soon as possible and, in any case, within 60 days from the date on which we send you an e-mail confirming the return or replacement of the non-conforming item. The refund will only be made when we are unable to replace the item with an identical item in perfect condition.

The amount paid for those products that are returned because of a defect or defect, when it actually exists, will be refunded in full, including the delivery costs incurred to deliver the item to you and the costs that you would have had to return it to us. The refund will be made in the same way as the payment was made. If the payment was made by credit card, the amount will be credited to the same card used to pay for the purchase.

 

CONTRACT INTEGRITY

These Terms and any document expressly referred to herein constitute the entire agreement between you and us relating to the subject matter of the Contract and supersede any prior covenant, agreement or promise made between you and us orally or in writing.

You and we acknowledge that we have agreed to enter into this Agreement without having relied on any representation or promise made by any other party or that could be inferred from any statement or writing in the negotiations between us prior to this Agreement, except as expressly set forth in these Terms and Conditions.

Neither you nor we shall have any appeals for any untrue statement made by another party, oral or written, prior to the date of the Contract and the only appeal available to the other party shall be for breach of contract in accordance with the provisions of these Conditions.

 

OUR RIGHT TO MODIFY THESE CONDITIONS

We have the right to revise and modify these Terms at any time. You will be subject to the policies and Conditions in effect at the time you place each order, unless we are required by law or governmental agency decision to make changes to such policies, Conditions or "Privacy Statement", in which case, any such changes will also affect orders previously placed by you.

 

APPLICABLE LAW AND COMPETENT JURISDICTION

The present General Conditions, as well as any other matter related to the use and contracting of LineArgent and more will be governed by the Spanish legislation in force. If the user is a consumer according to the applicable consumer and user regulations, the competent Courts and Tribunals to resolve any claim will be those established in said regulations.
